These Terms of Service ("Terms") govern your access to and use of the FloorConnect mobile application, website, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms.
1. The FloorConnect Platform
FloorConnect is a marketplace platform that facilitates connections between independent flooring installers ("Installers") and flooring retailers or businesses ("Stores").
FloorConnect does not provide flooring services, does not employ Installers, and does not guarantee job availability, acceptance, completion, pricing, or outcomes.
All users act as independent businesses.
2. Eligibility & Accounts
You must be at least 18 years old to use the Service.
You agree to provide accurate, current, and complete information and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
3. Installer Obligations
Installers represent and warrant that:
- they operate as independent contractors
- they hold all required licenses, insurance, and certifications applicable to their jurisdiction
- they will perform accepted jobs in a professional and lawful manner
Installers control which jobs they accept or decline. Declining jobs does not negatively affect account standing.
Failure to complete accepted jobs, maintain required documentation, or communicate reasonably may impact matching priority or account eligibility.
4. Store Obligations
Stores represent and warrant that:
- job postings accurately reflect scope, timing, and compensation
- payment obligations will be honored promptly
- installers will be treated fairly and professionally
Repeated inaccuracies, payment failures, or unresolved disputes may impact job visibility or account eligibility.
5. Job Offers & Matching
FloorConnect uses automated systems to present job opportunities based on multiple factors, including:
- skills and eligibility
- location and availability
- reliability indicators
- scheduling and travel considerations
FloorConnect does not guarantee that any job will be offered, accepted, or completed.
6. Reliability Scores
FloorConnect uses Reliability Scores as operational indicators to support fair and efficient matching.
Reliability Scores:
- are calculated automatically based on objective platform activity
- are not reviews, ratings, endorsements, or opinions
- do not measure workmanship, quality, or business reputation
Reliability Scores may influence job visibility, offer sequencing, and matching priority, but do not guarantee outcomes.
FloorConnect does not manually edit Reliability Scores except to correct platform errors or enforce policies.
7. Administrative Oversight & Overrides
FloorConnect maintains limited administrative oversight to:
- verify documentation
- resolve disputes
- correct platform errors
- apply temporary, time-limited overrides in exceptional cases
All administrative actions are logged and auditable.
FloorConnect reserves the right to suspend or restrict accounts that violate these Terms or applicable laws.
8. Billing & Payments
Store Fees
Stores may be charged a flat platform fee per verified completed job. Fees vary by market and are disclosed prior to posting.
Fees are assessed only after job completion and verification.
Payment Processing
Payments are processed by third-party providers (e.g., Stripe). FloorConnect does not store raw credit card data.
Failed payments, chargebacks, or disputes may impact account standing.
9. Disputes
Users may submit disputes through the platform.
Dispute outcomes may influence future matching and reliability indicators. No single dispute determines account standing.
FloorConnect may review disputes and take appropriate action in accordance with platform policies.
10. Data & Privacy
Use of the Service is subject to the FloorConnect Privacy Policy, which explains how personal data is collected, used, and shared.
11. Account Suspension & Termination
FloorConnect may suspend or terminate accounts that:
- violate these Terms
- provide false information
- engage in abusive or fraudulent behavior
- fail to maintain required documentation
- repeatedly disrupt platform operations
Users may request account deletion at any time through the app.
12. Independent Contractor Relationship
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between FloorConnect and any user.
Installers are independent contractors and are solely responsible for taxes, insurance, and legal compliance.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
FLOORCONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of Liability
To the maximum extent permitted by law, FloorConnect shall not be liable for indirect, incidental, special, consequential, or punitive damages.
FloorConnect's total liability shall not exceed the fees paid to FloorConnect in the preceding twelve (12) months.
15. Indemnification
You agree to indemnify and hold harmless FloorConnect from claims arising out of your use of the Service, job performance, disputes, or violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
17. Changes to These Terms
FloorConnect may update these Terms from time to time. Continued use of the Service constitutes acceptance of updated Terms.
